EU rules a mass."},"content":{"rendered":"<p>The <a href=\"https:\/\/www.gov.uk\/government\/publications\/open-standards-principles\/open-standards-principles\">open standard principles<\/a> updated recently (OSP 2015) including a list of <a href=\"https:\/\/opensource.org\/licenses\/alphabetical\">Open Source licences<\/a> approved by the Open Source Iniciative. It recognized that:<\/p>\n<ul>\n<li>Rights essential to implementation of the standard, and for interfacing with other implementations which have adopted that same standard, are licensed on a (RF)&nbsp;<strong>royalty free basis<\/strong> that is compatible with both open source &#8230; and proprietary licensed solutions. These rights should be irrevocable unless there is a breach of licence conditions<\/li>\n<\/ul>\n<p>But,&nbsp;now <a href=\"http:\/\/arstechnica.co.uk\/tech-policy\/2016\/04\/anti-innovation-eu-excludes-open-source-from-new-tech-standards\/\">EU exclude Open Source<\/a> from new tech standards. On the penultimate page of the ICT Standardisation Priorities document there is a problematic statement: <span style=\"color: #ff0000;\"><em>&#8220;ICT standardisation requires a balanced IPR [intellectual property rights] policy, based on FRAND licensing terms.&#8221;<\/em><span style=\"color: #000000;\">. <strong>F<\/strong><\/span><\/span><strong>RAND licencing<\/strong> that means&nbsp;&#8220;<strong>Fair, Reasonable, And Non-Discriminatory<\/strong>&#8221; licencing and this is&nbsp;incompatible with open source, which will therefore find itself excluded from much of the EU&#8217;s grand new Digital Single Market strategy.<\/p>\n<ul>\n<li>FRAND licensing <span style=\"text-decoration: underline;\"><span style=\"color: #000000; text-decoration: underline;\">requires a per-copy payment.<\/span><\/span>&nbsp;Free software on the contrary can be shared any number of times.<\/li>\n<\/ul>\n<p>The initial&nbsp;EIF 2004 (<a href=\"http:\/\/ec.europa.eu\/idabc\/servlets\/Docd552.pdf?id=19529\">European Interoperativity Framwork<\/a>) was totally in accordance with the Open-Source phylosophy<\/p>\n<div id=\"container\">\n<section id=\"content\" class=\"clearfix\">\n<article class=\"standalone\">\n<section id=\"article-guts\">\n<div class=\"article-content clearfix\">\n<ul style=\"text-align: left;\">\n<li>The standard is adopted and will be <strong>maintained by a not-for-profit organisation<\/strong>, and its ongoing development occurs on the basis of an open decision-making procedure available to all interested parties (consensus or majority decision etc.).<\/li>\n<li>The standard has been published and the standard specification document is available either freely or at a nominal charge. It must be permissible to all to copy, distribute and use it for <strong>no fee or at a nominal fee<\/strong><\/li>\n<li>The intellectual property\u2014i.e. patents possibly present\u2014of (parts of) the standard is made irrevocably <strong>available on a royalty-free basis<\/strong>.<\/li>\n<li>There are <strong>no constraints on the re-use<\/strong> of the standard.<\/li>\n<\/ul>\n<p>Nevertheless the <a href=\"http:\/\/ec.europa.eu\/isa\/documents\/isa_annex_ii_eif_en.pdf\">EIF 2010<\/a> change completly the policy. Include the definitions and characteristics of the OSS (<a href=\"http:\/\/www.opensource.org\/docs\/osd.\">Open Source Software<\/a>) and the different definition of the <a href=\"http:\/\/www.gnu.org\/philosophy\/free-sw.html.\">Free Software<\/a>, specifying his own opinion of OPENESS as:<\/p>\n<div id=\"container\">\n<section id=\"content\" class=\"clearfix\">\n<article class=\"standalone\">\n<section id=\"article-guts\">\n<div class=\"article-content clearfix\">\n<blockquote><p><script src=\"http:\/\/pagead2.googlesyndication.com\/pagead\/osd.js\"><\/script><script src=\"http:\/\/static.parsely.com\/code\/ptrack-v0.4.11-engaged-time.js\"><\/script><script src=\"http:\/\/srv-2016-04-26-06.config.parsely.com\/config\/arstechnica.co.uk\"><\/script><script src=\"\/\/a1.vdna-assets.com\/analytics.js\" async=\"\"><\/script><script src=\"\/\/www.google-analytics.com\/analytics.js\" async=\"\"><\/script><script src=\"http:\/\/b.scorecardresearch.com\/beacon.js\" async=\"\"><\/script><script src=\"http:\/\/www.googletagservices.com\/tag\/js\/gpt.js\" async=\"\" type=\"text\/javascript\"><\/script><script src=\"\/\/condenast-d.openx.net\/w\/1.0\/jstag?nc=5574-arstechnica\" type=\"text\/javascript\"><\/script><!-- Google DFP Code --><script type=\"text\/javascript\">\/\/ <![CDATA[\nvar googletag = googletag || {}; googletag.cmd = googletag.cmd || []; (function() { var gads = document.createElement(\"script\"); gads.async = true; gads.type = \"text\/javascript\"; var useSSL = \"https:\" == document.location.protocol; gads.src = (useSSL ? \"https:\" : \"http:\") + \"\/\/www.googletagservices.com\/tag\/js\/gpt.js\"; var node =document.getElementsByTagName(\"script\")[0]; node.parentNode.insertBefore(gads, node); })();<br \/>\n\/\/ ]]><\/script><\/p>\n<div id=\"container\">\n<section id=\"content\" class=\"clearfix\">\n<article class=\"standalone\">\n<section id=\"article-guts\">\n<div class=\"article-content clearfix\">\n<p>&#8220;If the <strong>openness principle<\/strong> is applied in full:<\/p>\n<ul>\n<li>All stakeholders have the same possibility of contributing to the development of the specification and public review is part of the decision-making process;<\/li>\n<li>The specification is available for everybody to study;<\/li>\n<li>IPR-Intellectual property rights related to the specification are <span style=\"color: #ff0000;\">licensed on FRAND terms<\/span>&nbsp;OR <em>on a royalty-free basis<\/em> in a way that <span style=\"text-decoration: underline;\">allows implementation in both<\/span> proprietary and open source software.&#8221;<\/li>\n<\/ul>\n<p>Now their is a mass problem.<\/p>\n<p><a href=\"https:\/\/catai.net\/blog\/wp-content\/uploads\/2016\/04\/EIF.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-10724 size-full\" src=\"https:\/\/catai.net\/blog\/wp-content\/uploads\/2016\/04\/EIF.png\" alt=\"EIF\" width=\"612\" height=\"791\" srcset=\"https:\/\/catai.net\/blog\/wp-content\/uploads\/2016\/04\/EIF.png 612w, https:\/\/catai.net\/blog\/wp-content\/uploads\/2016\/04\/EIF-600x775.png 600w, https:\/\/catai.net\/blog\/wp-content\/uploads\/2016\/04\/EIF-232x300.png 232w\" sizes=\"auto, (max-width: 612px) 100vw, 612px\" \/><\/a><\/p>\n<\/div>\n<\/section>\n<\/article>\n<\/section>\n<\/div>\n<\/blockquote>\n<\/div>\n<\/section>\n<\/article>\n<\/section>\n<\/div>\n<\/div>\n<\/section>\n<\/article>\n<\/section>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The open standard principles updated recently (OSP 2015) including a list of Open Source licences approved by the Open Source Iniciative.
